Terms of Service

1. Acceptance of Terms

By accessing or using Heartbeat ("the Service"), available at https://heartbeat.wedohype.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Heartbeat is an AI-powered customer relationship management (CRM) platform that:

  • Receives form submissions from Elementor (WordPress) forms via webhooks
  • Generates AI-powered email responses using third-party AI providers
  • Sends emails on behalf of users through their connected email accounts
  • Provides a dashboard for managing submissions, drafts, and sent emails

3. User Accounts

To use the Service, you must:

  • Create an account with a valid email address and secure password
  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized use of your account

You are solely responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or bulk commercial emails
  • Transmit any unlawful, harmful, threatening, abusive, or otherwise objectionable content
  • Violate any applicable local, national, or international laws or regulations
  • Infringe upon the intellectual property rights of others
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service for phishing, fraud, or any deceptive practices
  • Harvest or collect personal information of third parties without their consent

5. AI-Generated Content

The Service uses third-party AI providers (Anthropic and OpenAI) to generate email content. By using the Service, you acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or appropriate
  • You are responsible for reviewing AI-generated emails before sending them (especially in Draft Mode)
  • In Automatic Mode, emails are sent automatically without manual review; you accept full responsibility for content sent in this mode
  • We do not guarantee the quality, accuracy, or suitability of AI-generated content
  • You are solely responsible for all emails sent through the Service on your behalf

6. Email Sending

When you connect your email account (Gmail or SMTP) to the Service, you authorize us to send emails on your behalf. You agree to:

  • Comply with all applicable email regulations, including CAN-SPAM, GDPR, and similar laws
  • Only send emails to recipients who have consented to receive communications
  • Maintain accurate sender information in your email configuration
  • Accept responsibility for all emails sent through your connected email accounts

7. Webhook Integration

The Service provides webhook endpoints to receive form submissions from your WordPress/Elementor website. You are responsible for:

  • Properly configuring webhook integrations on your website
  • Keeping your API keys secure and confidential
  • Ensuring that form respondents are informed about how their data will be processed
  • Obtaining necessary consents from form respondents for data processing and email communication

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in our Privacy Policy.

9. Third-Party Services

The Service integrates with third-party services including but not limited to:

  • Anthropic (Claude AI models) for email generation
  • OpenAI (GPT models) for email generation
  • Google Gmail API for email sending
  • SMTP email providers

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of these third-party services.

10. Intellectual Property

The Service, including its design, features, and code, is owned by Heartbeat and protected by intellectual property laws. You retain ownership of your data, including form submissions, email content, and configurations. You grant us a limited license to process your data solely for the purpose of providing the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL HEARTBEAT, ITS OPERATORS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

We are not liable for any damages resulting from AI-generated content, including but not limited to inaccurate, incomplete, or inappropriate emails sent through the Service.

12. Indemnification

You agree to indemnify and hold harmless Heartbeat, its operators, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good faith negotiation, and if necessary, through binding arbitration or in the courts of the applicable jurisdiction.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
